Thank you for your interest in volunteering with Random Acts of Flowers - AVL. Volunteering with us helps us spread joy and allows people who share our values to nurture a culture of compassion and care.

Our volunteer’s range in age from elementary students to retirees. Individuals and groups – including schools, church groups, civic groups, businesses, and even sports teams who donate their time.

We deliver happiness, one bouquet at a time. This unexpected surprise is delivered to patients of hospitals, nursing centers, veterans’ centers and assistant living facilities in WNC.

RELEASE AND WAIVER OF LIABILITY

BLOOMS OF KINDNESS VOLUNTEER WAIVER OF LIABILITY
This Release and Waiver of Liability (the “Release”) executed by (the “Volunteer”) in favor of Blooms of Kindness, a non-profit corporation, their directors, officers, employees, agents and affiliates (collectively, “BOK"

The Volunteer desires to work as a volunteer for BOK and in engage in the activities related to being a volunteer at BOK (“Activities”), which may include pickup, processing and delivery of flowers and floral arrangements in the area served by BOK. The Volunteer hereby freely, voluntarily, and without duress executes this Release under thefollowing terms:
Release and Waiver: Volunteer does hereby waive, release and forever discharge and hold harmless BOK and it successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law orin equity, which arise or may hereafter arise from Volunteer’s Activities with BOK. Volunteer understands that this Release discharges BOK from any liability or claim that the Volunteer may have against BOK with respect to any bodily injury, personal injury, illness, death, or property damage that may result from the Volunteer’s Activities with BOK, whether caused by the negligence of BOK or its officers, directors, employees, or agents or otherwise.

Volunteer also understands that BOK does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance or medical expense reimbursement in the event of injury or illness.
Medical Treatment: Volunteer does hereby release and forever discharge BOK from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered by BOK or any other provider in connection with the Volunteer’s Activities with BOK.
Assumption of the Risk: Volunteer hereby expressly and specifically assumes the risk of injury or harm in the Activities and releases BOK from all liability for injury, illness, death, or property damage resulting from the Activities.

Insurance: The Volunteer understands that BOK does not carry or maintain health, medical, or disability insurance.

Each Volunteer is expected and encouraged to obtain his or her own medical or health insurance coverage.

Photographic Release: Volunteer does hereby grant and convey unto BOK rights, title, and interest in any and all photographic images and video or audio recordings made by BOK during the Volunteer’s Activities with BOK, including, but not limited to, the right to use such images or recordings for the promotion of BOK and any royalties, proceeds, or other benefits derived from such photographs or recordings.

Other: Volunteers shall not engage in political or religious activities while performing activities on behalf of BOK. Volunteer expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of North Carolina and that this Release shall be governed by and interpreted in accordance with the laws of the State of North Carolina.

Volunteer agrees that in the event that any clause or provision of this Release shall
be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.
